*These plants have been banned by two Connecticut laws: Public Act 03-136 and Public Act 04-203.
What’s Banned? The import, move, sale, purchase, transplant, cultivation, or distribution.
Penalties. The law provides for fines up to $100 per plant.
When Do the Bans Take Effect? All of these plants are currently banned.
What About Cultivars? The CT Green Industries take the position that the laws apply only and exactly to the plants specified. A cultivar of one of these plants would have a different botanical name. However, it would be left to a court to interpret the laws.
